Details Emerge Following Tuesday Arraignment
A 36-year-old Town of Tonawanda man is facing a second-degree murder charge following a formal indictment in State Supreme Court on Tuesday. Nicholas M. Malvaso appeared before Justice Kelly Vacco where he was accused of intentionally killing his 51-year-old wife, Tiffany L. Malvaso, inside their home on the 300 block of Cleveland Drive last month. Erie County District Attorney Michael J. Keane announced the arraignment, noting that paramedics and local police discovered the victim deceased after responding to an early morning 911 call on Saturday, May 16. The Erie County Medical Examiner’s Office officially ruled the death a homicide caused by severe blunt force trauma to the head.
Legal Strategy and Ongoing Prosecution
Following the arraignment, Malvaso remains held without bail as the prosecution prepares for the upcoming trial. If convicted of the Class A-I felony, he faces a maximum sentence of twenty-five years to life in prison. While the Erie County District Attorney's Office stated the evidence will prove the defendant intentionally caused his wife's death, defense attorneys are reportedly planning to argue that Malvaso lacked the intent to kill due to severe intoxication during the incident. Assistant District Attorneys Frank A. Strano and Justin T. Wallens from the Homicide Bureau are leading the prosecution for the county.
What Happens Next
The legal proceedings will move forward quickly as both legal teams prepare their respective arguments. Malvaso is scheduled to return to court for a pre-trial conference on Friday, June 26 at 9:30 a.m. The Town of Tonawanda Police Department continues to support the District Attorney's office with the ongoing investigation. Residents witnessing any signs of domestic abuse or suspicious activity in their neighborhoods are strongly advised to contact local authorities immediately.
